Abstract

The purpose of this paper is to analyze the fulfillment of the EC Law by the European Union Member States, studying the action for Member States "failure to fulfill obligations", under the Treaty as framed in Arts. 226-228 EC. The article will present the conception of infringement, the phases of the procedure and the innovations of the article 228 of the EC Treaty. After, some aspects of the application and the control of the fulfillment of the law will be discussed.
