Abstract

The paper offers a broad analysis of the draft laws presented in the last three years in the field of trade union representation and focuses on Italian system for employee representation at the workplace. Starting from the Consolidated Text on Union’s Representation signed by Confindustria and CGIL, CISL and UIL on 10 January 2014 (“Testo Unico sulla Rappresentanza”), the A. analyzes the anomaly of the Italian dual system confronted with systems dual channel present in other Eu countries (France, Spain, Germany, Netherlands). The Italian anomaly is due to the lack of a separation of funcions between RSA and RSU and the absence of a legal framework of employee participation in the workplace. The last part of the paper focuses on the guidelines for a reform which provides a separation of funcions between RSA and RSU, conferring participation rights to elected representatives and bargaining power to trade union representation.
