Abstract

The author takes an interdisciplinary approach to the problematic relationship between insolvency law and labour law, due to the fact that there are no rules intersecting both fields under Italian law. She examines recent labour law reforms, in particular law no. 92 of 2012 and the so-called Jobs Act, which have accentuated the points of friction between labour law and insolvency law, mainly on the issue of dismissals. She concludes that the new law no. 155 of 2017 reforming insolvency law and the rules for company restructuring - which envisages, as a general principle, co-ordination between restructuring and insolvency procedures and current labour law - could offer an opportunity to solve the technical and political problems that afflict the relationship between the two fields of law so that they can dialogue more effectively.
