    Abstract

    The paper deals with the set off of costs of litigation under Article 92, second paragraph, of the Italian Code of Civil Procedure especially after Constitutional Court decision No 77/2018, highlighting that, unlike certain vulgate, the set off of costs still requires very exceptional reasons.
